Buying Property in Sri Lanka
The specificity of Sri Lanka lies in the fact that the country does not have a single register of land plots, and there is no standard document confirming the cleanliness of a site. In each province of Sri Lanka, there is a branch of the land register, which is responsible only for a particular region. For example, if you want to purchase a site in the Tangalle area, then you need to check the legal status of the site or building in Tangalle or Hambantota. If the site / structure is in Unawatuna, then you need to check in Halle. In any case, these issues are dealt with by lawyers and lawyers of our company independently, excluding your worries and time in this matter.
A document confirming the right to own land Deed of Transfer indicates that a particular person or group of persons owns a plot or structure. A copy of the data is also entered in the Land Register, where our lawyers have the right to request information on the document number. It should be remembered that the function of the land registry is the fixation of data on the transaction, according to the information specified in the Purchase Agreement. The state does not verify the truth of the data. Purchases are made by our lawyers. In effect, for the duration of the transaction - it's your personal lawyer, that is, the person you trust the transaction support. Confidence is a very important point, because if a lawyer does not fully check the history of the site, or allows, consciously or unconsciously, inaccuracies in drafting the contract, the state will only record the fact of the conclusion of the Treaty. This can lead to subsequent problems, much later. It is in this regard that our lawyers conduct a thorough initial detailed verification of the entire history of ownership of the land. This should rule out legal problems after you obtain the rights to own and dispose of the property.
Types of land plots in Sri Lanka
In Sri Lanka, in terms of private ownership, it divides two types of land. These are Divided Lands, and Undivided Lands.

First type of land. Undivided Plot is usually a site that does not have an accurate record of its specific boundaries and location on the terrain. Such a site can only be donated from a citizen of Sri Lanka to a local citizen. Such land is usually cheaper. Foreigners are often attracted by the price of them, what scammers can use. The problem of unseparated sites is that at any moment a citizen of Sri Lanka can appear and claim his/her rights to a part of the land, because the site has no exact boundaries. And this is a serious problem. This happens because the sole owner of the land will inherit it for the whole family in a shared distribution, for example, 50% for the wife, 20% for each of the 2 children, and 10% for the other relative. Total for one plot of 4 owners. Each of them has a certain share, but nowhere is the exact location of the plot on the plan fixed. Court cases with this type of sites can last for decades, appeals can be filed an unlimited number of times, and the turn in court for appeals goes up to a dozen years. In this regard, you should know that after you have decided on the site selection, its thorough examination by lawyers is extremely important and necessary! Lawyers of Lankarus check all the papers before making deals carefully. So we protect you from possible problems in the future. Usually our experts check the ownership history of the sites over the past 15 years. This is sufficient in the context of the requirements of the laws on the seizure of plots and territories in Sri Lanka.
The second type of lands are Divided Plots. These are land plots with a clear plan and documentation. It is ideal for any deal, it can be easily and quickly put into your possession.
The final subspecies of the plots are donated land and lands with restrictions on certain activities. The state gave a lot of land for development, including in beach areas, to free use of Sri Lanka's population. Such a site can not be sold or leased to a foreigner, and one can only give it to another Sri Lankan citizen. Such areas are often subject to special conditions of use. We highly recommend avoiding such sites, and we inform our customers if we identify the fact that the site is just such a form of ownership. However, there is an opportunity to buy such a site, while we warn you of the risks and transfer all responsibility solely to you, because to complete a deal in a risky category of plots, you will need to request special permits from the owner for its sale and commercial activities. As other restrictions, the site may belong to protected areas, and these sites can only be used for agricultural activities, for example, for growing tea, rice, coconuts, and so on.
Building and construction in Sri Lanka
In our country there are a number of norms that stipulate construction. You should know and remember that in the coastal zone it is forbidden to erect buildings at a distance of more than 15 meters from the beach line. It is necessary to be convinced even before the beginning of construction, that on a site there is water and there is an electricity. The construction plan must be approved by a state accredited architect. Otherwise, the building may go under demolition. In questions of the construction team, it is better to rely on proven professionals, a company with a good and long reputation. You should also remember to report your building to the local Coast Conservation department in case you build in costal zone, up to 300 metres deep inside from the sea line.
